I think it couldn't hurt to put it in the contract -- though I should note that the question being asked here is *not* about the standard email disclaimers required by many organizations. It's about setups where an organization is not sending their customer e-mail directly, but instead having it done by an outside service (so that, for example, your "customer newsletter" doesn't come from newsletter@yourcompany.net, but from companynewsletter@exampleoutsourcer.com). -- Kyle Maxwell http://caffeinatedsecurity.com [krmaxwell@gmail.com]
