Well this is true. The legal system is a ssytem based on the art of retoric and not science. The inductive process used by the common law courts often flies in the face of impartial deductive resoning and scientific method. The aim of the court process is more often to confuse matters rather than to prove fact. Really, I was addressing what a lot of attorneys do to confuse and confound juries and judges and preserve an issue on appeal, i.e., challenging the credibility of the evidence through the individual collecting and manner it was collected. The more the technology involved the harder an attorney will work to discredit it. Technical evidence is hard to present and harder for juries to absorb. And if the attorney's done is job and laid enough ground work, (primarily claims of manufacture or non-preservation [are there any other?] by the IT guy) juries will simply ignore the evidence. ------------------------------------------------------------------------ --- This list is sponsored by: ByteCrusher Detect Malicious Web Content and Exploits in Real-Time.
