I'd suggest to unmask Nessus 2.2.9:

I did not have much time, so that was the GPL & short answer.
The longer & better answer is to switch to Nessus 3. There is no Gentoo
binary, but the SuSE 10 version works for me. So:
- emerge rpm if it is not done already
- remove the older Nessus2 version.
- download the SuSE 10 RPM from http://www.nessus.org/download/ and
install it. As kazillons of other RPM are missing, you'll have to run 
rpm --nodeps Nessus-3.0.5-suse10.0.i586.rpm
You can test 3.1.x if you are adventurous.

The scanner will be installed under /opt/nessus
